This website is operated by Tributes by Bjane and BJKustomz. Throughout this website, the terms "we," "us," and "our" refer to Tributes by Bjane and BJKustomz.

Tributes by Bjane and BJKustomz operate under the same business and offer custom and personalized products through this Shopify-powered website.

By visiting our website, purchasing a product, submitting an order, or otherwise using our services, you agree to these Terms of Service and any additional policies posted on our website.

Please review these Terms carefully before placing an order.

1. Online Store Terms

You may not use our products, website, designs, or services for any illegal or unauthorized purpose.

You may not use our website in a manner that violates applicable laws or infringes upon the rights of another person or business.

We reserve the right to refuse or cancel service where permitted by law, including orders involving fraudulent activity, abusive behavior, unauthorized use of intellectual property, or requests we cannot reasonably fulfill.

2. Custom & Personalized Products

Many products sold through our store are made specifically for the customer and may include photographs, names, dates, wording, colors, sizing, or other personalized information.

Customers are responsible for submitting complete and accurate information necessary to complete their order.

Please carefully review all information submitted with your order.

3. Customer-Submitted Photos & Content

By submitting photographs, artwork, logos, names, wording, or other materials for use in a custom product, you represent that you have the necessary permission or authority to provide those materials to us for the purpose of completing your order.

You remain responsible for the materials you submit.

We reserve the right to decline content that we reasonably believe is unlawful, infringes upon another person's rights, or is otherwise inappropriate for production.

4. Digital Proofs & Revisions

Products that include a digital proof will be sent to the customer for review before production.

Customers are responsible for carefully reviewing:

• Names and spelling
• Dates
• Photos
• Wording
• Colors
• Placement
• Design details
• Other personalized information

Orders include up to 2 revisions during the proofing stage unless otherwise stated on the product listing.

Additional revisions are $10 each.

Revisions are intended for reasonable corrections or adjustments to the existing design. Requests for an entirely different design or substantial changes from the original request may require an additional design fee.

5. Proof Approval

Once a customer approves the final digital proof, the design is considered final and production may begin.

No changes can be made after final proof approval.

By approving a proof, the customer confirms that they have reviewed and accepted the spelling, dates, photographs, wording, placement, colors, and other design details shown.

We are not responsible for errors contained in information supplied by the customer and approved on the final proof.

If the finished product differs from the approved proof because of an error made by us, please contact us so that we can review the issue.

6. Portfolio, Social Media & Promotional Use

We may photograph or record completed custom products for use in our business portfolio, website, social media accounts, marketing materials, advertisements, promotional content, and other examples of our work.

This permission applies to the completed product and design and does not grant us unrestricted permission to separately use every original photograph or file submitted by the customer.

Because custom products may contain personal photographs, names, dates, or other meaningful information, customers may request that their order remain private.

If you do not want your completed product photographed, recorded, posted, or otherwise used for promotional purposes, please notify us at Hello@tributesbybjane.com before your order enters production.

We will honor requests to keep an order private.

7. Prices & Payment

Prices are displayed on our website and may change without notice.

Full payment is required before design or production begins unless we expressly agree to different terms in writing.

An order is not considered ready for processing until required payment and necessary personalization information have been received.

Additional charges may apply for rush processing, express processing, additional revisions, significant design changes, upgraded materials, shipping, or other optional services.

8. Cancellations, Returns & Refunds

Because our products are custom and personalized, all sales are generally final.

Once design work or production has begun, an order cannot be canceled or refunded.

If you need to request a cancellation before design work begins, contact us as soon as possible. Cancellation requests are not guaranteed.

Custom products cannot be returned or exchanged because of a change of mind, an incorrect size or option selected by the customer, or information that the customer submitted and subsequently approved.

9. Production Times

Production times vary depending on the product, order size, customization requirements, season, and current workload.

Production time is separate from shipping/transit time.

Any processing timeframe displayed on our website is an estimate unless we expressly guarantee otherwise in writing.

The applicable processing timeline and any rush options should be reviewed before ordering.

Customers purchasing items for a funeral, memorial service, repast, birthday, graduation, sporting event, holiday, or other date-specific occasion are responsible for providing the correct event date when requested.

10. Rush & Express Orders

Rush or express processing may be available for qualifying products depending on our current workload, materials, and the requested completion date.

Payment of a rush or express fee applies to production speed unless otherwise expressly stated.

Rush processing does not automatically guarantee a carrier's shipping or delivery timeframe.

Availability should be confirmed when required by the applicable product or ordering instructions.

11. Shipping & Delivery

Shipping times are separate from production times.

Once an order is transferred to a shipping carrier, carrier transit times may be outside of our direct control.

Customers are responsible for providing a complete and accurate shipping address.

Please review our Shipping Policy for information regarding processing, shipping, delivery issues, damaged shipments, incorrect addresses, and other shipping matters.

12. Product Appearance

We make reasonable efforts to display product photographs, colors, designs, and examples accurately.

Colors may appear differently depending on screen settings, lighting, materials, printing processes, and other factors.

Because many products are handmade or individually customized, minor variations may occur between product examples and completed orders.

These reasonable variations are not necessarily considered defects.

13. Intellectual Property

Unless otherwise stated, our original designs, product photographs, graphics, branding, website content, logos, and other original business materials belong to us or are used with appropriate authorization.

You may not reproduce, copy, sell, distribute, or commercially use our original business content without permission.

Customer ownership of photographs or other materials submitted for personalization is not transferred to us merely because those materials are used to fulfill an order.

14. Third-Party Services

Our store is powered by Shopify and may use third-party services for payment processing, shipping, website functionality, and other business operations.

Third-party services may have their own terms and privacy practices.

We are not responsible for the independent practices of third-party websites or services that are outside of our control.
